PE Digital Seal Acceptance by State: What AHJs Accept

By Jeremy Mills, CEO & Founder, Apex Grid Engineering — USAF Veteran. · Updated 2026-09-15

Digital PE seals are accepted in most states when applied as verifiable digital signatures tied to the licensee, and most portal-based AHJs accept digitally sealed PDFs — but confirm with the specific AHJ, since some still require wet seals on paper.

I'm Jeremy Mills, CEO & Founder of Apex Grid Engineering and a U.S. Air Force veteran. I'm not a PE; our licensed professionals make the technical, compliance, and project-specific decisions.

Illustrative diagram of the professional engineer review and seal workflow: drawings are reviewed against a checklist, sealed by a licensed PE, and issued as a permit set.

Digital signature vs. seal image

The technical distinction drives the legal one. A compliant digital signature uses cryptographic technology to bind the signature to the licensee's verified identity and to the document's exact contents — any alteration after signing invalidates the signature, which is the tamper-evidence boards require. A seal image is just pixels: copyable, alterable, attributable to no one. Boards that have addressed the question require the former and reject the latter. Our signing workflow produces true digital signatures with the PE's credentials, applied per each permit state's board rules, so every digitally sealed PDF we deliver carries the evidentiary properties the rules contemplate. Clients and AHJs can verify the signature in any standards-compliant PDF reader.

Confirming AHJ acceptance

Board permission does not guarantee AHJ acceptance, so confirmation is a formal due-diligence step on every project. I check three things with the AHJ: whether digitally sealed PDFs are accepted for the specific permit type, the portal's current file and signature formatting standards, and whether any document in the package still requires a wet seal on paper. This takes minutes and prevents the most avoidable submittal failure — an intake rejection for seal formatting on an otherwise complete, fully reviewed set. AHJ requirements evolve as portals update, so I confirm against current practice, not last year's experience. The confirmation goes in the project record alongside the sealed deliverables.

Digital seal submittal checklist

A digitally sealed submittal is ready when these items are confirmed. The seal's legal validity depends on getting the method right. • Permit state's board rules verified to permit digital sealing with stated requirements • True digital signatures applied — cryptographic, tied to the licensee, tamper-evident • AHJ confirmed to accept digitally sealed PDFs for the permit type; portal standards met • Any wet-seal-on-paper exceptions identified and produced physically where required • Sealed PDFs verified openable with intact signatures before submittal — test, don't assume

What else do project teams ask?

Is a scanned image of a PE seal acceptable?
Generally no — and this is the most common digital-seal mistake. A scanned seal image pasted into a PDF is not a digital signature: it carries no cryptographic tie to the licensee, it is not tamper-evident, and it can be copied onto any document by anyone. Most state boards that permit digital sealing require a verifiable digital signature, and AHJs that check will reject image seals. Our sealed PDFs use true digital signatures through compliant signing workflows. If a set arrives with what looks like a photocopied seal image, treat it as unsealed until verified.
Which states accept digital PE seals?
Most states permit digital or electronic sealing under their board rules, provided the seal is applied as a verifiable digital signature tied to the licensee with tamper-evident properties. The specific requirements — signature technology, appearance, accompanying certifications — vary by board, and our PEs apply seals per the permit state's rules. But board permission is only half the question: the AHJ receiving the documents must also accept digitally sealed submittals in its process. I verify both levels for every project — board rule and AHJ practice — because either one can be the constraint.
Do electronic plan review portals accept digitally sealed PDFs?
The major ones do — LADBS ePlanLA, Phoenix SHAPE PHX, Mecklenburg County's Accela, Denver's electronic permitting — digitally sealed PDFs are the standard submittal format in these systems. Each portal has file and formatting standards (and occasionally signature-appearance preferences) that the sealed set must meet, and I confirm the current requirements before uploading. Portal acceptance is the norm now; the exceptions are specific document types or smaller jurisdictions that have not digitized. When in doubt, a five-minute confirmation with the AHJ beats an intake rejection.
When is a wet seal still required?
Some AHJs still require original wet seals and signatures on paper for certain documents — typically in jurisdictions without full electronic review, or for specific record documents the jurisdiction archives physically. The requirement is set by the AHJ, not by the board, so it varies locally and changes as jurisdictions digitize. Our practice: confirm with the AHJ during due diligence, and produce physically sealed and signed paper sets where required. The review-and-seal behind a wet seal is identical to the review behind a digital one — the application method is logistics, not engineering.
