Is an Engineer Stamp Required for My Deck Project in New York?

By Jeremy Mills, CEO & Founder, Apex Grid Engineering — USAF Veteran. · Updated 2026-09-15

Usually yes for anything beyond a small prescriptive deck — New York municipalities generally require a New York-licensed PE to seal the structural sheets for elevated decks, roofed decks, and non-prescriptive designs. Heavy snow loads and NYC's DOB review are the signature New York issues. Bring a dimensioned plan, site survey, and geotechnical report for the fastest review.

New York Deck Stamp Requirements

New York's municipalities — New York City, Buffalo, Rochester, Yonkers — review structural drawings for decks under the state Uniform Code, and the PE seal is the standard requirement for non-prescriptive decks. The seal must show the engineer's name, New York PE number, and date, and the engineer must be in responsible charge of the engineering. Elevated decks, rooftop decks, and decks with roofs are treated the same at the structural level. In New York City, the DOB's plan-examination process adds objections and review layers beyond the seal itself. Owner-builders don't escape the requirement: the department asks for the seal regardless of who drafted the plans.

What the New York Deck Structural Review Involves

The engineer reviews the deck plan and elevations, designs the footings below the frost line — glacial soils and rock are the norm — sizes beams, joists, and posts, and checks the ledger connection and the lateral system for heavy snow, wind, and seismic demand per the state Uniform Code. Upstate snow loads are the most commonly miscalculated item. Hot tubs add concentrated loads that prescriptive tables don't cover. Bring the site survey, the geotechnical report, and the deck plans. Snow-load errors are the item most deck plans miss.

Your New York Deck Stamping Checklist

Use this checklist before engaging an engineer for your deck: • Engineer of record holds an active New York PE license, verifiable on the state roster • Dimensioned deck plan and elevations ready for structural review • Site survey showing setbacks, easements, and existing structures • Snow loads matched to the site jurisdiction • Frost-depth compliance verified for all footings • Ledger connection to the house detailed and verified • Engineer confirms they'll respond to plan-check corrections on sealed sheets • Seal shows name, New York PE number, and date on every sealed sheet

What else do project teams ask?

Does a ground-level deck need an engineer stamp in New York?
A small ground-level deck that fits the prescriptive tables may not need an engineer. Elevated decks, rooftop decks, and roofed decks almost always need the sealed structural sheets.
How does New York City's DOB process differ?
The NYC DOB adds plan-examination objections beyond the PE seal — structural, zoning, and special inspection requirements. Budget for a longer review cycle and objections responses.
Why do snow loads matter for New York decks?
Upstate New York's snow loads are heavy and lake-effect driven. Out-of-state prescriptive plans often use the wrong ground snow value — the engineer verifies it against the local jurisdiction.
What slows down deck permits in New York?
Wrong snow loads, NYC DOB objections, and undersized ledger details. Bring the survey and soil data and the review moves fastest.
